Image Use Agreement

We noticed your image and would like to display it on our media and social media channels including but not limited to our website, Facebook, Instagram, Twitter, WeChat, Weibo, Youtube, marketing and advertising materials, and onsite display [“(Marketing Media”] so that others will enjoy it as we did. To help you decide whether you want to share your image with us, we would like to explain to you the terms of the use of your image on our Marketing Media as set out in this Agreement:-

1. If you are agreeable to sharing your image with us, you have the option of replying to our Instagram post with #yesGBB and by doing so, you give us your permission to use your image in the manner indicated in this Agreement. If you do not reply with #yesGBB, we will not use your image.
   
2. When you reply to our Instagram post with #yesGBB, we want you to understand that the effect of doing so is as set out below in this Agreement.
   
3. You represent and warrant that you own the image and there are no other individuals/entities with ownership rights or claims over it.
4. By replying #yesGBB, you grant Gardens by the Bay and its affiliates a non-exclusive and non-revocable right to reproduce the image in any form (including, but not limited to, video, internet posting, reproduction, display, email, publication, and distribution), either through our own services or services provided by third parties, throughout the world in any medium now known or later developed and without restriction or limitation. You agree that your image may be used by Gardens by the Bay and its affiliates (either alone or in conjunction with sketches, cartoons, captions, films, art work, textural matter or other photographs) and that Gardens by the Bay and its partners and affiliates may alter your image and make derivative works as it may deem fit or necessary for the intended use.
5. You agree that while Gardens by the Bay will make all reasonable efforts where practically and commercially viable to give you credit for your photo and/or provide a link back to your Instagram account, you accept that such credit is not mandatory and your permission for us to use your image is not contingent upon such credit being given.
6. You agree to waive any right to inspect and/or approve the finished work incorporating the image or the advertising copy that may be used in connection your image or the use/s for which the final and finished work may be applied to. Further, you waive any claims to royalties with regards to your image or our final or end product of the finished work.
7. Finally, you agree that if any provision, or any portion of any provision, contained herein is determined to be invalid under any statute or rule of law, then it shall, to that extent alone, be deemed omitted, and the remainder of this Image Use Agreement shall remain in full force and effect. This Image Use Agreement shall be governed by the laws of Singapore.

If you do not agree to these terms, we understand and no further action is required. We are really happy to see Gardens by the Bay on your social media platforms and look forward to seeing new photos in your future posts.
